This Privacy Policy governs the websites and practices of brands that are owned by Advantice Health, LLC and that display or link to this Privacy Policy (each, a “Site”). and it describes our privacy practices for the activities described in this Privacy Policy. Advantice collects Personal Information from our customers as detailed in our Privacy Policy.  The following serves as our notice at collection of Personal Information in accordance with California law.

What categories of Personal Information do we collect?

  • Identifiers: This includes your name, unique user identifier, mailing address, email address, mobile phone number, or other similar identifiers. This data will be sold or shared in accordance with our Privacy Policy.  We may retain this data as long as necessary to provide services to you, after which we delete your data in accordance with our corporate retention policy.

    • Social Media Information. This includes information you post on our social media pages.  This also includes your social media profile information.
    • Information You Post or Submit. This includes information when you contact us through the Website Contact Form on our Site. This also includes our Ratings & Reviews.
    • Device Information. This includes the type of device you use to access our Site.  It may also include your device identification number, device model, browser, carrier information, or mobile operating system.
    • Usage Information. This includes how you interact with the Site.
  • The aforementioned Personal Information described in subdivision (e) of Section 1798.80 will be sold or shared in accordance with our Privacy Policy. We may retain this data as long as necessary to provide services to you, after which we delete your data in accordance with our corporate retention policy.
  • Commercial Information: This includes your credit/debit card number and billing address. We may also collect information about the products or services purchased, obtained, considered or returned, as well as other purchasing or consuming histories, behaviors or tendencies. This data will be sold or shared in accordance with our Privacy Policy. We may retain this data as long as necessary to provide services to you, after which we delete your data in accordance with our corporate retention policy.
  • Internet or other Network Activity Information: This includes information related to your interactions with our Site or advertisements. This data will be sold or shared in accordance with our Privacy Policy. We may retain this data as long as necessary to provide services to you, after which we delete your data in accordance with our corporate retention policy.
  • Geolocation Data: This includes precise location information from your device. We may retain this data as long as necessary to provide services to you, after which we delete your data in accordance with our corporate retention policy.
  • Inferences: We collect profile inferences that we draw from your information and web activity to create a personalized profile so we can better identify goods and services that may be of interest. This data will be sold or shared in accordance with our Privacy Policy. We may retain this data as long as necessary to provide services to you, after which we delete your data in accordance with our corporate retention policy.
  • Sensitive Personal Information: As mentioned above (“Geolocation Data”), this includes precise location information from your device.  We may retain this data as long as necessary to provide services to you, after which we delete your data in accordance with our corporate retention policy.

What are the purposes for which we collect and use your Personal Information?

Business and Commercial Purposes:

  • To Perform a Contract
  • To Comply with a Legal Obligation
  • To Provide the Functionality of the Site and Fulfilling your Requests. This includes providing the functionality of the Site to you and providing you with related customer service; to respond to your inquiries and fulfill your requests, such as to send you documents you request or email alerts; to send you important information regarding our relationship with you or regarding the Site, changes to our terms, conditions, and policies and/or other administrative information.

Notice of Third Party Plugins that Control Collection of Personal Information We use third party services on our website where the third party directly controls the collection of Personal Information on our behalf.  These services are targeted marketing and advertising services.  You have the right to opt-out of the “sale” or “sharing” of your Personal Information as detailed in our Privacy Policy.

2. HOW WE COLLECT YOUR PERSONAL INFORMATION Advantice collects Personal Information in several ways, including through (A) information you provide to us directly; (B) information that we automatically collect; and (C) information we receive from third parties.

A. Information You Provide

Advantice collects information from you when you choose to share it with us. This may include when you visit a Site, request information from us, request customer support, or otherwise communicate with or contact us. The information we collect may include your biographical information (i.e., name, address, email address, mobile number), payment information (i.e., credit/debit card number), and additional information collected in connection with Site participation (i.e., Website Contact Form).

B. Information Automatically Collected

Whenever you visit or interact with a Site, we, as well as third-party advertisers and/or service providers, may use cookies, web beacons, pixel tags, or other technologies to automatically or passively collect information about your online activity.

Please note that we automatically collect the following information about you:

In addition to the purposes described above, we will process Personal Information when we have a lawful basis for processing, including when:
  • we are legally obliged to process it;
  • we need to process your information in order to provide you with the products or services you have requested;
  • you have consented to such processing; and/or
  • we have a legitimate interest for processing your data – e.g., for fraud prevention; direct marketing; network and information systems security; data analytics; enhancing modifying or improving a Site; identifying usage trends; determining the effectiveness of promotional campaigns; and personalization of the Site.

 

4. INFORMATION WE SHARE We may share the information we collect from and about you as described below.

  • Our Affiliates: We may share your information with Advantice affiliates and subsidiaries for business, operational, promotional and marketing purposes.
  • Service Providers: We may share your information with our service providers that provide business, professional, marketing, analytics, or technical support functions for us, help us operate our business and the Site, or administer activities on our behalf.
  • With Third Parties for Marketing Purposes.  This may include third parties in whose products or services we believe you may be interested.  These third parties may also share your information with others.  These third parties may use your information for their own marketing purposes or the marketing purposes of others.  This may include the delivery of interest-based advertising, which serves you advertisements based on your interests and activities on the internet.
  • Legal Obligations; Safety: We may access and disclose your information to respond to subpoenas, judicial processes, or government requests and investigations, or in connection with an investigation on matters related to public safety, as permitted by law, or otherwise as required by law. We may disclose your information to protect the security of a Site, servers, network systems, and databases. We also may disclose your information as necessary, if we believe that there has been a violation of our Terms & Conditions, any other legal document or contract related to a Site, or the rights of any third party.
  • Sale or Transfer of Business or Assets: We may sell or purchase assets during the normal course of our business. If another entity acquires us or any of our assets, information we have collected about you may be transferred to such entity. In addition, if any bankruptcy or reorganization proceeding is brought by or against us, such information may be considered an asset of ours and may be sold or transferred to third parties. Should such a sale or transfer occur, we will use reasonable efforts to try to require that the transferee use Personal Information provided through this Site in a manner that is consistent with this Privacy Policy.
  • Aggregate or Anonymous non-personal information: We may also share aggregate, anonymous, or de-identified non-personal information with third parties for their marketing or analytics uses.

5. YOUR CHOICES

A. Advertising Choices

Certain parts of a Site may require cookies, pixels, or similar technologies. For example, we may use cookies or other technologies to deliver more relevant advertising and to link data collected across other computers or devices that you may use. 6. EEA & UK RIGHTS NOTICE We respect your privacy rights and provide you with reasonable access and rights to the Personal Information that you may have provided through your use of the Site. If you live in the European Economic Area (“EEA”) or United Kingdom (“UK”) and wish to access, amend, delete, or transfer any Personal Information we hold about you, you may contact us as set forth in the “Contact Us” section. At any time, you may object to the processing of your Personal Information in our legitimate interests, except if otherwise permitted by applicable law. If you believe there has been a violation of your privacy rights, please contact us as set forth in the “Contact Us” section below. You also have a right to lodge a complaint with your local data protection authorities. You may decline to share certain Personal Information with us, in which case we may not be able to provide to you some of the features and functionality of the Site. We will retain your Personal Information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. In some circumstances we may anonymize your Personal Information (so that it can no longer be associated with you) for analytics purposes, in which case we may use this information indefinitely without further notice to you.

 

7. YOUR PRIVACY RIGHTS

A. Explanation of Applicable Privacy Rights

If you are a resident of California, Colorado, Connecticut, Utah, or Virginia, you may take advantage of the following privacy rights:

    • Right to Know:  You have the right to know what Personal Information we have collected about you, including the categories of Personal Information, the categories of sources from which the Personal Information is collected, the business or commercial purpose for collecting, selling, or sharing Personal Information, the categories of third parties to whom we disclose Personal Information, and the specific pieces of Personal Information we have collected about you.
    • Right to Delete:  You have the right to delete Personal Information that we have collected from you, subject to certain exceptions. Note that there are some reasons we will not be able to fully address your request, such as if we need to complete a transaction for you, to detect and protect against fraudulent and illegal activity, to exercise our rights, for our internal purposes, or to comply with a legal obligation.
    • Right to Correct:  You have the right to correct inaccurate Personal Information that we may maintain about you, subject to appropriate verification.
    • Right to Opt-Out of the Sale or Sharing of Personal Information / Right to Opt Out of Targeted Advertising:  You have the right to opt out of the “sale” or “sharing” of your Personal Information, and to opt out of “targeted advertising,” as such terms are defined in applicable state privacy laws, to third parties and to affiliated companies that do not share the same brand name.  This means that, if you opt out, going forward, we will not sell or share your Personal Information with such third parties to use for their purposes, including cross-context behavioral advertising, unless you later direct us to do so. [Advantice is working toward processing opt-out preference signals, such as the Global Privacy Control, as a request to opt out.]
    • Right to Limit the Use and Disclosure of Sensitive Information:  You may ask us to limit our use of your sensitive personal information, including for advertising or marketing purposes.

B. How to Submit a Request

To take advantage of your right to know, delete, or correct as described in section 7.A of this Policy, or to submit an appeal of a denial of your privacy rights, please contact us by email at privacy@advanticehealth.com, or by using the How to Contact Us section below. We may request certain information to verify your identity before we can respond to your access and deletion requests.  We will confirm receipt of your request within 10 business days and will respond to your request within 45 calendar days, after proper verification, unless we need additional time, in which case we will let you know.

To take advantage of your right to opt out of the sale or sharing of Personal Information or to opt out of targeted advertising, please click on the Privacy Settings link which also is on our Site footer or contact us using the How to Contact Us section, below.

We will not discriminate against you because you exercised your rights under this section of the Privacy Policy.

C. Agent Requests

You may authorize someone to make a privacy rights request on your behalf (an authorized agent). Authorized agents will need to demonstrate that you’ve authorized them to act on your behalf or must demonstrate they have power of attorney pursuant to applicable probate law. Advantice retains the right to request confirmation directly from you confirming that the agent is authorized to make such a request, or to request additional information to confirm the agent’s identity. An authorized agent is prohibited from using a consumer’s Personal Information, or any information collected from or about the consumer, for any purpose other than to fulfill the consumer’s requests, for verification, or for fraud prevention.

D. Data Protection Disclosures

Categories of Personal Information Disclosed for Business Purposes

In the last 12 months, Advantice has disclosed the following categories of Personal Information for a business purpose: identifiers, contact information, payment card information, commercial information, internet or other electronic network activity, geolocation data, and inferences drawn from the above.  We disclosed each category to service providers as described in Section 4 of this Privacy Policy (“Information We Share”).

E. Categories of Personal Information Sold or Shared

In the last 12 months, Advantice has sold or shared the following categories of Personal Information: identifiers, contact information, commercial information, internet or other electronic network activity, geolocation data, and inferences drawn from the above.

Each category of Personal Information was sold or shared with advertising networks, data analytics providers, and social networks for marketing, advertising, and analytics.

We do not knowingly sell or share Personal Information about persons under the age of 16.

F. Use and Disclosure of Sensitive Personal Information:

To the extent that we collect, use, or share “sensitive personal information” as that term is defined in applicable California law, we limit our use or disclosure of the sensitive personal information for permitted business purposes.

 

8. CHILDREN’S PRIVACY Protecting children’s privacy is important to us. We do not direct the Site to, nor do we knowingly collect any Personal Information from, children under the age of sixteen.  If we learn that a minor has provided Personal Information through the Site, we will use reasonable efforts to remove such information from our files.

 

9. SECURITY OF YOUR INFORMATION We have taken certain physical, administrative, and technical steps to safeguard the information we collect from and about our customers and Site visitors. While we make every effort to help ensure the integrity and security of our network and systems, we cannot guarantee our security measures.

 

10.REVISIONS TO THIS PRIVACY POLICY We reserve the right, at our sole discretion, to change, modify, add, remove, or otherwise revise portions of this Privacy Policy at any time. When we do, we will post the change(s) on the Site.  Your continued use of the Site following the posting of changes to these terms means you accept these changes.  If we change the Privacy Policy in a material or substantive way, we will provide appropriate notice to you.
